The CFTC initiated litigation against Arizona, Connecticut, and Illinois last week, asserting exclusive jurisdiction over event-based derivatives.

Federal filings further outlined the risks of inconsistent enforcement across jurisdictions targeting emerging financial instruments. The regulator stated: “The CFTC is seeking a preliminary injunction and temporary restraining order to stop Arizona from enforcing its criminal laws against federally regulated prediction markets.” The agency added that Arizona’s actions relied on state gambling statutes, which the regulator argues are preempted by federal derivatives law.
